He is not a firefighter like a firefighter

I will try to explain in a few lines the difference between a firefighter - a member of the VOLUNTEER OF FIREFIGHTERS (hereinafter referred to as SDH) and a firefighter - a member of the UNIT OF THE VOLUNTEER OF FIREFIGHTERS (hereinafter referred to as JSDH).

The names are almost identical, so I understand that most citizens do not see the difference. But just one letter and the letter "J" before SDH, ie JSDH, divides these organizations fundamentally.

JSDH

The unit of the volunteer fire brigade is governed by Act 133/85 Coll. as amended, ie the Act "On Fire Protection".
The founder of JSDH according to §29 of Act 133/85 Coll., Is a municipality.

Municipality in independent competence in the field of fire protection:

  • a) Establishes a unit of the voluntary fire brigade of the municipality, which performs fire fighting and rescue work
    during natural disasters and other extraordinary events and performs other tasks according to a special legal regulation in its territorial district, provides members of the unit of the voluntary fire brigade of the municipality for firefighting and rescue work during natural disasters and other extraordinary events outside working hours.

  • b) Maintains the ability of the unit of the voluntary fire brigade of the municipality

  • c) Provides training for members of the voluntary fire brigade of the municipality

  • d) Provides for the material and financial needs of the unit of the voluntary fire brigade of the municipality and fire protection.

  • e) Provides care for members of the voluntary fire brigade of the municipality, as well as care for employees included in the fire brigade units of companies, members of other units of the voluntary fire brigade of the municipality or companies, or persons called for personal assistance under § 18, if they intervene for aggravated conditions or in the case of a longer-lasting intervention in the municipality

etc.

SDH

The Volunteer Fire Brigade is a civic association working in the field of fire protection. It is governed by Act No. 83/1990 Coll., As amended, ie the Act "On Associations of Citizens". This association, as well as other civic associations, may not, according to §5 of this Act, perform the function of state bodies, unless a special law provides otherwise. They must not manage state bodies and impose obligations on citizens who are not their members.

Civic associations, public benefit organizations and other bodies and organizations may be provided with a subsidy in accordance with Act No. 218/2000 Coll., On Budgetary Rules and on Amendments to Certain Related Acts (Budgetary Rules) and Act No. 250/2000, .Sb on budgetary rules of territorial budgets.

It is therefore clear from the above that SDH and JSDH have nothing in common from a legal point of view. However, they can cooperate, as remembered by Act 133/85 Coll. in its fifth part in §75.

Civic associations, public benefit organizations and other bodies and organizations operating in the field of fire protection shall assist in the performance of tasks in the field of fire protection, in particular by:

  • a) help to find members of the units of the voluntary fire brigade of the municipalities

  • b) participate in the training of members of units of voluntary fire brigades of municipalities

  • c) participate, with the consent of the owner, in the performance of maintenance, repairs of fire equipment, material means of fire protection and fire protection facilities, including water sources

  • d) take part in activities aimed at fire prevention, in particular in preventive educational activities between citizens and young people

  • e) participate in publishing and publishing activities and in the documentation of the history of fire and firefighting

In conclusion:

A member of the JSDH does not have to be a member of SDH and vice versa. SDH can operate in the municipality, while the municipality may not be obliged to establish a JSDH. Or, conversely, the municipality will set up a unit without SDH operating in the municipality. If someone still does not have a clear difference between JSDH and SDH, replace JSDH with the abbreviation JPO, ie fire protection unit.
